This document is intended to inform you about the processing of your personal data in the context of using the website www.sidetrading.ro (the ‘Site’).

If you are a visitor to the Site, Side Trading S.R.L. will process the personal data you directly provide while using the Site — for example, data submitted through the Contact or Careers sections — insofar as you choose to contact us in this manner.

If you are a visitor to the Site, Side Trading S.R.L. processes your personal data as follows:

• For marketing activities, namely for sending, via remote communication means (e-mail, SMS), commercial communications regarding the products and services offered by Side Trading S.R.L. through the Site.
  Legal basis: The processing of your data for this purpose is based on your consent, if you choose to provide it.
  You may express your consent for this processing by completing and checking the appropriate box in the newsletter subscription form available on the Site. You may unsubscribe from receiving such commercial communications at any time, using the option provided at the end of each e-mail/SMS containing commercial communications.
  Providing your data for this purpose is voluntary. Refusing to provide consent for processing your data in this way will not have any negative consequences for you.

• For handling complaints and requests, monitoring traffic, and improving your experience on the Site.
  Legal basis: The processing of your data for this purpose is based on the legitimate interest of Side Trading S.R.L. in ensuring the proper functioning of the Site and in constantly improving the experience of visitors, including by resolving comments, questions, or complaints.
  Providing your data for this purpose is voluntary. Refusal to provide your data for this purpose will not have any negative consequences for you.

• For carrying out analyses and reports regarding the operation of the Site, as well as for creating consumer preference profiles, mainly with a view to improving the experience offered on the Site.
  Legal basis: The processing of your data for this purpose is based on the legitimate interest of Side Trading S.R.L. in constantly improving the customer experience on the Site.
  Providing your data for this purpose is voluntary. Refusal to provide your data for this purpose will not have any negative consequences for you.

As a principle, Side Trading S.R.L. will process your personal data only for as long as is necessary to achieve the processing purposes mentioned above.

If you are a client, we will process your personal data for the entire duration of the contractual relationship and thereafter in accordance with the legal obligations incumbent upon Side Trading S.R.L. (for example, in the case of financial-accounting supporting documents, which must be retained for 10 years from the end of the financial year in which they were created, as required by law).

If you withdraw your consent for the processing of data for marketing purposes, Side Trading S.R.L. will cease processing your personal data for this purpose, without affecting the processing carried out by Side Trading S.R.L. based on the consent you provided before its withdrawal.

For the fulfillment of the processing purposes, Side Trading S.R.L. may disclose your personal data to partners, to third parties or entities that support Side Trading S.R.L. in carrying out its activities through the Site (such as courier companies, IT service providers), or to central/local public authorities, in the following illustrative cases:

• for the administration of the Site;

• in situations where such communication is necessary for awarding prizes or other benefits to data subjects as a result of their participation in promotional campaigns organized by Side Trading S.R.L. through the Site;

• for maintaining, customizing, and improving the Site and the services provided through it;

• for data analysis, testing and research, monitoring usage and activity trends, developing security features, and authenticating users;

• for sending marketing communications, under the conditions and within the limits provided by law;

The personal data provided to Side Trading S.R.L. may be transferred outside Romania, but only to countries within the European Union or to the United States of America.

Under the conditions provided by personal data protection legislation, as data subjects you benefit from the following rights:

• Right to information – the right to receive details regarding the processing activities carried out by Side Trading S.R.L., as described in this document;

• Right of access to data – the right to obtain confirmation from Side Trading S.R.L. regarding whether or not your personal data are being processed, as well as details regarding such processing activities (e.g. how data are processed, the purposes of processing, the recipients or categories of recipients of the data, etc.);

• Right to rectification – the right to obtain, without undue delay, the correction by Side Trading S.R.L. of inaccurate/unjustified personal data, as well as the completion of incomplete data. Rectification/completion will be communicated to each recipient to whom the data have been transmitted, unless this proves impossible or involves disproportionate efforts;

• Right to erasure of data (“right to be forgotten”) – the right to obtain the deletion of your data without undue delay where one of the following applies:

  • the data are no longer necessary for the purposes for which they were collected or processed;

  • consent is withdrawn and there is no other legal ground for processing;

  • the data subject objects to processing and there are no overriding legitimate grounds for processing;

  • the personal data have been unlawfully processed;

  • the personal data must be erased for compliance with a legal obligation;

  • the personal data have been collected in connection with the provision of information society services under EU or national law applicable to the controller.
    Following a request for deletion, Side Trading S.R.L. may anonymize the data (thereby removing their personal nature) and continue processing for statistical purposes;

• Right to restriction of processing, where:

  • the accuracy of the data is contested, for a period enabling verification of their correctness;

  • processing is unlawful, and the data subject opposes erasure and requests restriction of use instead;

  • the controller no longer needs the personal data for processing purposes, but the data are required by the data subject for the establishment, exercise, or defense of legal claims; or

  • the data subject has objected to processing (other than for direct marketing), for the period during which it is verified whether the legitimate grounds of the controller override those of the data subject;

• Right to data portability – (i) the right to receive personal data in a structured, commonly used, and machine-readable format, and (ii) the right to have those data transmitted directly by Side Trading S.R.L. to another data controller, where technically feasible and under the conditions provided by law;

• Right to object – may be exercised by sending a request as indicated below:

  • at any time, for reasons related to your particular situation, to the processing of data carried out under the legitimate interest of Side Trading S.R.L. or under the public interest, except where Side Trading S.R.L. demonstrates compelling legitimate grounds for processing which override your interests, rights and freedoms, or where the purpose is the establishment, exercise, or defense of legal claims;

  • at any time, free of charge and without any justification, to the processing of your data for direct marketing purposes;

• Right not to be subject to an automated individual decision – the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you in a similar way;

• Right to lodge a complaint with the National Supervisory Authority for Personal Data Processing or with the competent courts, to the extent you consider it necessary.
